GENERAL TERMS AND CONDITIONS OF SALE

Article 1: Purpose and acceptance of the general sales conditions The general terms and conditions of sale described below govern relations between IPC TEXTILES FRANCE, whose registered office is located at 38, Avenue de la Croix Saint-Martin, 03200 Vichy, France, registered in the Cusset Trade Register B 828 099 499, Intracommunity VAT No. FR81828099499, e-mail: info@ipc-textiles.com and customers wishing to place an order on the www.ipc-textiles.com website. IPC TEXTILES FRANCE reserves the right to adapt or modify these terms and conditions of sale at any time. In the event of modification, the general conditions of sale in force on the day of the order will be applied to each order. By placing an order, the customer acknowledges having read and accepted the general terms and conditions of sale below.

Article 2: Purchasing products, orders and deliveries To be able to buy on the site, the customer must be of legal age and legally capable, or if he is a minor be able to justify the agreement of his legal representatives. To order, customers must identify themselves by completing the form available on the site, or by entering their e-mail address, password and telephone number. Mandatory fields must be filled in for the order to be processed. The information provided by the customer to IPC TEXTILES FRANCE during an order must be complete, accurate and up to date. IPC TEXTILES FRANCE reserves the right to ask the customer to confirm, by any appropriate means, his identity, eligibility and the information provided. Once the user has been identified, he/she must validate the delivery address (The customer must expressly indicate all information relating to delivery: exact delivery address, access code, name on intercom, etc... ), an order form with the products, quantities and prices of the selected products, the total amount of the order, the method of payment, the customer's contact details, the billing address and the delivery address.

Delivery is only made once payment has been accepted after the order has been placed. After confirmation of the order and payment, IPC TEXTILES FRANCE undertakes to dispatch the available products to the customer either by La Poste or DPD for packages weighing less than 30 kg, within 2 to 4 working days, or by another carrier for packages weighing more than 30 kg.

In the event of unavailability of an ordered product, the customer will be informed by email. The cancellation of the order of this product and its possible refunding will then be carried out, the remainder of the order remaining firm and definitive.

IPC TEXTILES FRANCE reserves the right to refuse to make a delivery or to honour an order from a CLIENT who has not paid in full or in part for a previous order, or with whom a payment dispute is in progress.

Article 3: Withdrawal and Returns The customer has the right to return or restitute the product to IPC TEXTILES France no later than 14 days following the communication of his decision to withdraw. This period begins on the date of delivery of the product. The customer has 14 days from the date of delivery to return the product. After this date, no refund will be possible. To exercise his right of withdrawal, the customer must notify his decision to withdraw from this contract by means of a declaration by e-mail to info@ipc-textiles.com or by post to IPC TEXTILES France, 38 Avenue de la Croix-Saint-Martin 03200 Vichy. The cost of returning the product is borne by the customer. Goods must be returned in their original condition and packaging. No retraction will be accepted if the returned product is unfit for re-marketing. The product must be accompanied by all accessories. Failing this, the product may be returned to you, at your expense, or a discount will be applied. Any refund will be made within 14 days of receipt of the products by us at our address at IPC TEXTILES France, 38 Avenue de la Croix-Saint-Martin 03200 Vichy and will be made by the same means of payment used for the order.


Article 4 : Prices

The prices of the goods sold are those in force on the day the order is taken. They are denominated in euros and calculated exclusive of tax. Consequently, they will be increased by the rate of VAT and transport costs applicable on the day the order is placed.

IPC TEXTILES FRANCE reserves the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated when the order is registered.

Article 5: Terms of payment and security

Payment for orders is made :

Payment by credit card: payment is made via PayPlug's secure bank servers. The customer's bank details will only be known by the bank and encrypted before being sent over the network. No banking information passes through the IPC TEXTILES FRANCE site. Payment by credit card is therefore perfectly secure. After payment, the customer will receive a Payplug receipt to confirm payment.


Bank cheque . Orders are reserved for 7 working days. Cheques should be made payable in euros to IPC TEXTILES France, and sent to IPC TEXTILES France, 38 Avenue de la Croix-Saint-Martin 03200 Vichy. The order will be processed once the cheque has been cashed. Beyond the period of 7 days, without receipt and cashing of the check by IPC TEXTILES France, it will be canceled.


Bank transfer . The order is reserved for 7 working days. The order is processed on receipt of the bank transfer.


If payment is refused, the order will be automatically cancelled and the customer notified by e-mail.

Article 6: Liability

IPC TEXTILES France shall under no circumstances be held liable for the delay or non-performance of the contract entered into:
in the event of non-performance or improper performance of contractual obligations attributable to the customer, in particular during order entry.
in the event of force majeure, and in particular in the event of strikes by postal services, carriers, and disasters caused by flood or fire. In the event of strikes or delays, the purchaser is not entitled to claim damages.

Article 7 : Disputes and applicable law

These General Terms and Conditions of Sale are governed by French law.

In the event of litigation with customers, the courts of Cusset shall have jurisdiction.

Article 8 : Reservation of ownership

IPC TEXTILES FRANCE retains ownership of the goods sold until full payment of the price, in principal and in accessories. In this regard, if the buyer is subject to receivership or liquidation, IPC TEXTILES FRANCE reserves the right to claim, as part of the collective proceedings, the goods sold and unpaid.

Article 9 : Warranty

The customer benefits from the legal warranty against hidden defects. In order to invoke the legal warranty against hidden defects, the following 3 conditions must be met
The defect must be hidden, i.e. not apparent at the time of purchase.
The defect must render the good unusable or greatly diminish its usefulness.
The defect must exist at the time of purchase.

Once the customer has provided proof of the hidden defect, he/she may choose between a full refund if the product is returned, or a partial refund if it is not returned, provided that the customer has complied with the care and washing instructions on the product labels.

Article 10: Intellectual property

All elements of the www.ipc-textiles.com website , domain names, texts, graphics, images, logos, sounds, photographs and other items are the exclusive property of IPC TEXTILES FRANCE.

Any reproduction, in whole or in part, on any electronic or non-electronic medium, present or future, is prohibited without the express prior authorization of IPC TEXTILES FRANCE;

The site, the designs created and the Deco Dell'Arte brand are the property of IPC and have been registered with the Institut National de la Propriété Industrielle (INPI).

Article 11: Legal information and personal data IPC TEXTILES FRANCE collects via cookies personal data about its customers, necessary for the proper execution of the contract. The customer may at any time access personal data concerning him and held by IPC TEXTILES France and request their modification or total deletion.
